Can a real estate agency sell a property that isnt listed with them?
I saw a Real Estate Agents sign on a property that I had been looking at through another Agency. I called them up to ask for information etc on the property. The agent then said they had no such listing on that property now, or previously.
Then 4weeks later the real estate agent i was working with to begin with tells me the property has been sold by the agency that said they didnt have it as a listing.
Can they do that? Sell a property that isnt listed with them. And also giving me deceptive/misleading information? Where they said categorically that they didnt have it listed. ??

Hi Kilkatim, This is a great question that does come up from time to time. It will depend on what authority the vendor has signed. "Off market" is a bit of a buzz word in real estate at the moment, but if anyone wants to sell a property technically it is "on the market" it just may not be advertised. Hopefully This was an oversight and not deliberate.

Yes there is a section on the authority that allows for commission sharing. So this can happen via a referral or an agent may have introduced a buyer to the seller and the contract was signed without a listing.

Hi Kitkatim,
It depends on the authority that was signed by the vendor. If a general authority was signed, several agents may have the property listed/on their books. It may have been an "Off Market" listing and not everyone in that particular office may have been aware of it when you spoke with them. There are many different scenarios. If it is something that is concerning you, I would call the office in question and ask a few questions to piece it together.
